FASHN reserves the right to modify or discontinue offering the Services to any person or entity at our discretion, and to change eligibility criteria at any time. These Terms do not apply where prohibited by law, and in such cases, you are not authorised to access or use the Services.
FASHN provides AI-powered image generation and editing services, including but not limited to: virtual try-on, product-to-model generation, image editing, background replacement, model generation, face swaps, image upscaling, reframing, image-to-video conversion, and related AI image services. These Services are available through our website, web application, mobile application, and API.
To provide these Services, your images and prompts are processed using a combination of proprietary FASHN technology and third-party AI services. Where third-party providers are used, processing is transient and performed solely to fulfil your requests. We require our third-party providers to handle your data in a manner compatible with our Privacy Policy.
FASHN reserves the right, at its sole discretion, to modify or replace any of these Terms, or change, suspend, or discontinue the Services (including without limitation, the availability of any feature, database, or content) at any time. Such changes will be made by posting a notice on the FASHN website or directly communicating them to you via email. We may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability. It is your responsibility to regularly check the Terms of Use for changes. Your continued use of the Services after any modifications indicates your acceptance of the new Terms.
You must be at least 16 years old to use the Services, or the minimum age of digital consent in your jurisdiction, whichever is higher.
Permitted Use: You may use our Services for any lawful AI image generation and editing purpose, including personal and commercial use in accordance with your subscription plan. You must have the right or explicit consent to use any images of identifiable individuals that you upload.

Content Responsibility: You are solely responsible for all content you upload and all outputs generated from your inputs. You are responsible for ensuring your content complies with these Terms and applicable laws.
Monitoring and Enforcement: FASHN reserves the right to monitor usage and take appropriate action against anyone violating these Terms, including immediate termination of access, reporting to law enforcement authorities, and pursuing civil or criminal liability.
Your Ownership: You retain all ownership rights to the images and content you upload to our Services. Nothing in these Terms transfers ownership of your content to FASHN.
License You Grant to FASHN: By using the Services, you grant FASHN a limited, non-exclusive, royalty-free licence to:
This licence exists solely to operate the Services and terminates when you delete the content or your account, except for content retained by organisations as described in the Organisations section below. We do not use your content for AI model training, marketing, or promotional purposes.
Generated Outputs: You may use the outputs generated by our Services for personal or commercial purposes in accordance with your subscription plan. Generated outputs are subject to the same storage and access terms as your uploaded content. Your right to use generated outputs is subject to the rights you hold in the input content.
FASHN Intellectual Property: All logos, marks, and designations of FASHN are trademarks or registered trademarks owned by FASHN. The Services, including their design, features, and functionality, are owned by FASHN and protected by intellectual property laws. You are granted a non-exclusive, limited, non-transferable, non-sublicensable, and non-assignable licence to access and use the Services for personal or business purposes, subject to your compliance with these Terms.
Copyright Infringement: FASHN will terminate or disable the accounts of users who are repeat copyright infringers in circumstances deemed appropriate by FASHN.
Organisation Access: Our Services support multi-member organisations. Organisation owners can invite members and manage access. All predictions and generated content within an organisation are visible to all members of that organisation.
Billing: Organisation owners are responsible for billing and subscription management for the organisation.
Owner Account Deletion: If an organisation owner deletes their account, the organisation and all associated data (including predictions by all members) will be deleted. Members will lose access to organisational data but retain their personal accounts.
We use analytics and advertising services to measure the effectiveness of our marketing and improve our Services. Purchase and signup events may be shared with advertising platforms for conversion measurement. Hashed personal data may be shared with advertising platforms for this purpose. Please refer to our Privacy Policy for full details on data sharing and your opt-out options.
You agree to defend, indemnify, and hold harmless FASHN, its affiliates, and their respective employees, contractors, directors, and suppliers from any liabilities, losses, claims, and expenses, including reasonable legal fees, arising from or related to your use or misuse of the Services, the content you upload or generate, or any violation of these Terms.
FASHN reserves the right to assume exclusive defence and control over any matter for which you are required to indemnify FASHN, and you must cooperate with FASHN in asserting any available defences.
Use at Your Own Risk: Your use of the Services, including the website and all content, is entirely at your own risk. The Services and content are provided on an "AS IS" and "AS AVAILABLE" basis. FASHN disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
AI-Generated Content: Outputs generated by our AI services may contain inaccuracies, artefacts, or unexpected results. FASHN does not guarantee the accuracy, quality, or suitability of any generated content. You are responsible for reviewing and validating all outputs before use.
Limitation of Liability: FASHN, its directors, employees, agents, partners, suppliers, content providers, successors, and assigns will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to lost profits, data loss, cost of procurement of substitute goods or services, or other intangible losses, regardless of the theory of liability. This limitation applies to:
Maximum Liability: In no event will FASHN's aggregate liability for all claims relating to the Services exceed the greater of £500 or the amount you paid FASHN in the 12 months preceding the claim.
Time Limit for Claims: Any claim or cause of action arising out of or related to these Terms or the Services must be filed within one (1) year after such claim arose, or be forever barred.
Modifications and Interruptions: FASHN reserves the right to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. FASHN will not be liable for any modification, suspension, or discontinuance of the Services.
Jurisdictional Variations: Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, some of the above limitations may not apply to you.
This section affects your legal rights. By agreeing to these Terms, you and FASHN consent to resolve any disputes through binding arbitration, which means that you waive any right to have those disputes decided by a judge or jury. All disputes, claims, or causes of action arising from or related to these Terms or your use of the Services will be exclusively resolved through arbitration, except for matters that may be taken to small claims court.
You and FASHN agree that any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis. Neither you nor FASHN will seek to have any dispute heard as a class action or in any other proceeding in which either party acts in a representative capacity.
You may opt out of this arbitration agreement by providing written notice to [email protected] within 30 days of first accepting these Terms. This notice must include your full name and email address associated with your account.
The arbitrator's decision will be final and binding on all parties, and may be entered as a judgment in any court of competent jurisdiction.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
Third-Party Links: Links on our Services may lead to third-party websites. FASHN has no responsibility for the content or practices of these websites. The inclusion of links does not imply endorsement.
Assignment: You may not assign these Terms without the prior written consent of FASHN. FASHN may assign them without restriction.
Severability: If any part of these Terms is held unenforceable, the rest remains in effect.
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and FASHN, superseding all prior communications.
Non-Waiver: The enforceability of these Terms is not waived by any failure of FASHN to enforce any provision.
No Agency: Nothing in these Terms creates a partnership, joint venture, or agency relationship between you and FASHN.
